Terms of Service

1. Agreement

These Terms of Service (the “Terms”) govern your access to and use of lukany.co (the “Site”), operated by Lukany LLC, a South Carolina limited liability company (“Lukany”, “we”, “our”, or “us”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms do not by themselves create a consulting engagement. Paid services are governed by a separate written agreement signed by both parties (a “Services Agreement”). If there is any conflict between these Terms and a Services Agreement, the Services Agreement controls for that engagement.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site. By using the Site, you represent that you meet these requirements.

3. Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use of, the Site by any other party. You will not:

• attempt to gain unauthorized access to the Site or its underlying systems;
• upload, transmit, or introduce any malicious code, malware, or disruptive content;
• use the Site in a way that interferes with its normal operation, security, or integrity;
• scrape, harvest, or collect data from the Site other than as expressly permitted;
• misrepresent your identity or affiliation.

4. Intellectual Property

The Site, including its text, graphics, logos, and underlying code, is owned by or licensed to Lukany LLC and is protected by intellectual-property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and view the Site for lawful, personal or internal-business purposes. All other rights are reserved.

“Lukany” and the Lukany logo are trademarks of Lukany LLC.

5. Submissions and Feedback

If you send us feedback, suggestions, or ideas about the Site or our services, you grant Lukany LLC a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and incorporate that feedback in any manner, without obligation to you. Please do not send us confidential information through the Site's contact form or other public channels.

6. Third-Party Links

The Site may contain links to third-party sites or services. We do not control, endorse, or assume responsibility for third-party content, products, or services. Use of any third-party site is at your own risk and subject to the third party's terms and policies.

7. Disclaimer

The Site is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that any content on the Site is accurate, complete, or current.

8. Limitation of Liability

To the maximum extent permitted by law, in no event will Lukany LLC or its members, officers, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your access to or use of the Site, even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to these Terms or the Site will not exceed one hundred U.S. dollars (USD 100).

The foregoing limitations do not apply to liability that cannot be limited under applicable law.

9. Indemnification

You agree to indemnify and hold Lukany LLC and its members, officers, employees, and contractors harmless from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your violation of these Terms or your misuse of the Site.

10. Governing Law and Venue

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising out of or relating to these Terms or the Site will be the state or federal courts located in Charleston County, South Carolina, and you consent to the personal jurisdiction of those courts.

11. Changes

We may update these Terms from time to time. We will update the “Last updated” date above. Your continued use of the Site after changes become effective constitutes your acceptance of the updated Terms.
